Terms of Service

Last updated: 28 October 2026

The terms for using buildsinfinity.com and for engaging us to build software. Our products each have their own terms, linked in section 3.

1. Acceptance of These Terms

These Terms of Service are an agreement between you and BuildsInfinity Technologies, a sole proprietorship (Udyam Registration No. UDYAM-UP-28-0210008) ("BuildsInfinity Technologies", "we", "us"). They apply when you use buildsinfinity.com and, together with the documents in section 3, when you engage us for software development services.

By using this website or engaging our services you agree to these Terms. If you are accepting on behalf of a business, you confirm you have authority to bind it.

2. Who We Are and What We Offer

We build and operate software products, and we provide custom software, website, web application and mobile app development, integration, modernisation and support services.

3. Products and Client Engagements Have Their Own Terms

Each product we operate has its own Terms of Service, Privacy Policy and Refund Policy, which you accept when you sign up for that product. Those documents, not these Terms, govern your use of the product:

For development services, the proposal, statement of work or contract we agree with you (the "Agreement") sets out the scope, deliverables, timeline, fees, payment milestones and ownership terms. If the Agreement conflicts with these Terms, the Agreement prevails.

4. Using This Website

  • Use the site only for lawful purposes.
  • Do not attempt to gain unauthorised access to the site or our systems, probe or scan them for vulnerabilities without permission, or disrupt their operation.
  • Do not scrape the site in bulk, or submit spam, malicious code or false information through our forms.

Content on this site — including blog posts, case studies and guides — is for general information. It is not professional, legal or financial advice, and we do not guarantee it is complete or current.

5. Development Services

  • Estimates of time and cost are based on the information available when they are given. Changes in scope, delayed approvals or inputs, or third-party dependencies can change them; we will tell you as soon as we know.
  • You agree to provide timely access, content, feedback and decisions we reasonably need. Delays on your side may move the timeline.
  • Changes to the agreed scope are handled through a written change request, which may change fees and timelines.
  • Fees are payable as set out in the Agreement. Amounts are exclusive of GST and other applicable taxes unless stated otherwise.
  • Third-party services used in the project (hosting, app stores, APIs, licences) are subject to their providers' terms and charges, which are your responsibility unless the Agreement says otherwise.

6. Intellectual Property

The content, design, logos and trademarks on this website belong to us or our licensors. You may not copy or reuse them except as the law allows.

Ownership of deliverables from a development engagement is governed by the Agreement. Unless it says otherwise, ownership of the custom work created specifically for you passes to you on full payment of the related fees. We keep ownership of our pre-existing tools, libraries, know-how and generic components, and grant you a licence to use them as part of the deliverable. Open-source components remain under their own licences.

7. Confidentiality

Anything you share with us before a project contract is protected by our Non-Disclosure Agreement, which applies automatically. During an engagement, each side will keep the other's non-public business information confidential and use it only for the engagement, except where disclosure is required by law. A separately signed NDA, where there is one, prevails over this section.

8. Your Responsibilities for Data

If you give us access to personal data of your customers or users so we can deliver a service, you are responsible for having a lawful basis and any consent needed to share it with us. We will handle it as your processor, as described in our Privacy Policy.

9. Disclaimer of Warranties

This website is provided "as is" and "as available". Except as expressly stated in an Agreement, we do not warrant that the site or any deliverable will be uninterrupted or error-free, or fit for a particular purpose. Nothing here excludes a warranty that cannot lawfully be excluded.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or business opportunity.

Our total aggregate liability arising out of or relating to these Terms or a development engagement is limited to the fees you actually paid us under the relevant Agreement in the twelve months before the event giving rise to the claim. Nothing here excludes liability that cannot lawfully be excluded.

11. Indemnity

You agree to indemnify us against third-party claims arising from content, materials or data you supply to us, or from your breach of these Terms or of applicable law.

12. Ending an Engagement

Either side may end a development engagement as set out in the Agreement. Unless it says otherwise, you pay for work completed up to the date of termination, and we hand over the work paid for. We may suspend work if undisputed invoices remain unpaid after reminder.

13. Governing Law and Disputes

These Terms are governed by the laws of India.

Please contact us first at [email protected] — most issues are resolved that way. Any dispute that cannot be resolved will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration is Gautam Buddha Nagar, Uttar Pradesh, India, and the language is English. Subject to this, the courts at Gautam Buddha Nagar, Uttar Pradesh have exclusive jurisdiction.

Nothing in this section takes away a remedy the law gives you as a consumer, including the right to approach a consumer commission.

14. Changes to These Terms

We may update these Terms. The date at the top is the current version. Changes do not alter an Agreement already signed unless both sides agree in writing.

15. Grievance Officer and Contact

For any complaint about our website or services, contact our Grievance Officer. We acknowledge every complaint within 24 hours and resolve it within 15 days.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a right is not a waiver of it. You may not assign these Terms without our consent.
